Texas Motels Lose Appeal of Bankruptcy Suit Over Winter Storm

Two Texas motels lost their effort to revive a lawsuit against an insurer over payments for damages caused by Winter Storm Uri in 2021 after the Fifth Circuit ruled they weren’t entitled to more money than they received.

Arlington, Texas-based Viva Inn Inc. and its owner New York Inn Inc. failed to provide evidence to back their claims related to building repairs, lost contents, and business interruptions, according to a Thursday decision by a three-judge panel of the US Court of Appeals for the Fifth Circuit.
