Supermarket Chain Seeks to Sink Chubb’s Opioid Coverage Case

A regional grocery chain asked a Virginia federal court to toss or pause Chubb Ltd.'s lawsuit seeking to avoid paying for opioid-related litigation pending the resolution of a parallel case filed this week in Indiana state court.

Chubb’s suit represented “procedural fencing” and the judge should allow the dispute to be resolved through the more comprehensive Indiana suit from the grocer, Food City Supermarkets LLC and K-VA-T Food Stores Inc. said in a motion to dismiss and accompanying memo filed Tuesday in the US District Court for the Western District of Virginia.
