Rite Aid Wins Chubb Coverage for Opioid Litigation Defense Costs (1)

Rite Aid Corp. can tap insurer Chubb for legal costs the retail pharmacy incurred while defending against lawsuits related to its alleged role in the U.S. opioid epidemic, a Delaware court ruled.

The opioid cases, funneled into multidistrict litigation, met the insurance policy’s requirement that resulting costs stemmed from bodily injury, Judge Eric Davis said Tuesday in a 43-page opinion. Plaintiffs, including local governments, sued for damages they claim to have incurred from Rite Aid’s sale of opioid products.
