Progressive Insurance Beats Segway Rider’s Bid for Crash Payout

New Jersey scooter riders hit by cars can’t claim the same insurance protections as pedestrians and cyclists, an appeals court ruled Wednesday in a first-of-its-kind decision for the state.

A rider of a Segway Ninebot KickScooter Max, which tops out under 16 miles per hour, sued Progressive Insurance Co. for medical expenses and injuries after he was struck by an insured motorist. The case was dismissed because “low-speed electric scooters” are excluded under New Jersey’s no-fault benefit system, the Superior Court of New Jersey Appellate Division ruled in an unauthored opinion.
