RLI Insurance Co. sued Otter Products LLC seeking a declaratory judgment that it doesn’t owe coverage for a proposed class action against the smartphone case maker.
The insurer’s suit, which seeks a finding that it owes no duty to defend Otter against the class action under the company’s directors and officers liability policy, was filed Thursday in the US District Court for the District of Colorado.
The underlying class suit alleged that Otter failed to honor its “limited lifetime warranty” on OtterBox smartphone and tablet cases by denying warranty claims for repair or replacement.
