Opioid Wholesaler Wins Insurance Battle Against Chubb Unit

A Chubb Ltd. unit must pay for a North Carolina drug wholesaler’s legal defense costs and any liability in dozens of opioid lawsuits after a federal court refused to apply two insurance policy exclusions.

“Mutual Drug has shown that the policies issued by Chubb provide coverage, and Chubb has not shown that any exclusions apply,” District Judge Catherine C. Eagles of the US District Court for the Middle District of North Carolina said Thursday.

“It is hard to think of anything the policy would cover if Chubb’s sweeping interpretation were adopted,” she added.
