NY Developer Loses Appeal on Insurance Coverage for EEOC Claim

A New York housing developer failed in its appeal seeking insurance coverage for a federal discrimination claim filed by a former security officer at one of its construction sites who said her supervisor sexually harassed and abused her.

An exclusion for sexual and physical abuse in StarStone Specialty Insurance Co.'s policy issued to Joy Construction Corp. bars defense and indemnity coverage for the charge filed with the US Equal Employment Opportunity Commission, the US Court of Appeals for the Second Circuit said in a summary order Friday.
