Norfolk Southern Sues Insurer for Wrongful Death Legal Costs

Norfolk Southern Corp. sued a W.R. Berkley Corp. insurance unit and a contractor for legal defense costs in a separate lawsuit brought by the estate of a contractor employee who was killed while replacing railroad tracks.

Nautilus Insurance Co. insured the contractor, National Salvage & Service Corp., under a commercial general liability policy.

A coverage provision for additional insured parties under the Nautilus policy required the insurer to pay the rail company’s legal bills, Norfolk Southern argued in a complaint filed Monday in the US District Court for the Southern District of New York.
