An insurer sued a commercial building subcontractor and other defendants, seeking a ruling that it has no duty to defend or indemnify them in an underlying state court action involving claims of bodily injury from carbon monoxide exposure at a motorcycle facility in California.
Policies issued by Middlesex Insurance Co. contained pollution exclusions barring coverage for bodily injury arising from exposure to carbon monoxide within a commercial building, the insurer said in a complaint filed Tuesday in the US District Court for the Central District of California.
