Marketing Firm Likely Owes Liberty Mutual in Telemarketing Row

A marketing firm hired by Liberty Mutual Group Inc. likely has to pay a settlement on the insurer’s behalf in a suit against it over Telephone Consumer Protection Act violations committed by a contractor the firm hired, a federal appeals court said.

“Notwithstanding a thorny question of appellate jurisdiction, we agree with the district court that Digitas breached its warranty and that Liberty Mutual satisfied the requisite preconditions to trigger Digitas’s indemnity obligation,” Judge Jeffrey R. Howard of the US Court of Appeals for the First Circuit wrote in a Wednesday opinion.
