Several insurers are suing a marine construction company, seeking a ruling that they owe it no coverage for pollution claims brought by the state of Texas after the company’s dredging vessel struck a liquid propane pipeline and caused an explosion.
The insurance policy issued to Orion Marine Construction Inc. only covers fines and penalties related to the discharge of oil or hazardous substances on navigable waters, and the claims made by Texas relate to air contamination, the insurers said in a complaint filed Monday in the US District Court for the Southern District of New York.
