Liberty Wins Reversal in Construction Injury Insurance Dispute

A Liberty Mutual Insurance Co. unit convinced the Eighth Circuit to reverse a lower court ruling that had favored a construction company in a dispute over who pays for a $2.5 million workers’ injury settlement.

The US District Court for the Western District of Missouri wrongly granted summary judgment to HNTB Corp. when there were “key facts in dispute” over whether the insurance policy excludes coverage for the incident, the US Court of Appeals for the Eighth Circuit said on Tuesday.
