Justin Baldoni Sued by Insurer Over Blake Lively Harassment Suit

The costs of litigating an employment suit filed by actress Blake Lively against actor and director Justin Baldoni and Wayfarer Studios LLC aren’t covered under the studio’s management liability insurance, its carrier said in a lawsuit.

Lively sued Baldoni and various associates in December, alleging she experienced sexual harassment on the set of the film “It Ends With Us.” Her suit came shortly after the New York Times reported on an alleged campaign by Baldoni and his team to smear Lively in response to her accusations of misconduct.

The insurer’s complaint was filed Monday in the US District Court for the Southern District of New York. It alleges that Wayfarer, which was co-founded by Baldoni, knew that Lively had complained of sexual harassment prior to the inception of a July 2023 Harco National Insurance Co. policy.

The suit, which also names Baldoni as a defendant, says the studio didn’t inform Harco of a potential claim, a condition required for coverage. As a result, Lively’s suit isn’t covered under its 2023 or 2024 policies, Harco said, asking the court to issue a declaratory ruling.

Additionally, although the lawsuit was filed during the July 2024 to July 2025 policy period, it was related to a November 2023 demand letter sent by Lively and would be treated as a single claim first made in the 2023 policy period, the complaint said.

Harco said that in any event, coverage was precluded under both policies due to Wayfarer’s prior knowledge of the claim.

Baldoni filed defamation claims against Lively and the New York Times in January, but that case was dismissed in June.

Wayfarer didn’t immediately respond to a request for comment.
