Regional supermarket chain K-VA-T Food Stores Inc.'s insurers lobbed new forum-shopping accusations against the grocer in motions to dismiss its suit over opioid liability coverage.
“As grocery store operators, Plaintiffs K-VA-T Food Stores, Inc. and Food City Supermarkets, LLC are used to having options—skim or 2% milk, chocolate or vanilla ice cream,” said Federal Insurance Co., which as the sole party incorporated in Indiana filed a separate motion to dismiss on March 14 in the Indiana Superior Court, where the grocer filed its coverage suit.
