A Colorado hospital’s excess insurer isn’t required to pay out its $40 million policy limits to resolve claims against the hospital over its inadequate surgical sterilization procedures, a federal appeals court said.
AdHealth Ltd. “owes coverage only for the claims of a single patient that trigger the excess policies’ liability threshold, not for coverage of multiple patients’ claims grouped together,” the US Court of Appeals for the Tenth Circuit said in a Friday opinion, affirming a lower court order.
