Insurer Seeks to Rescind Policy Over Privacy Law Compliance

An employment practices insurance policy issued to an Illinois freight trucking company should be rescinded because the policyholder wasn’t compliant with the state’s biometric privacy law until 2019 and provided false information on its application, the insurer said in a lawsuit.

The policy bars coverage for several underlying lawsuits against the company alleging violations of the Biometric Information Privacy Act because it wouldn’t have been issued without the alleged misrepresentations on the application, Lyndon Southern Insurance Co. said in a complaint filed Tuesday in the US District Court for the Northern District of Illinois.
