Illinois Federal Court Sides With Insurer on BIPA Coverage

An Illinois federal court handed a win to an insurance carrier in a dispute over coverage for an underlying lawsuit alleging violations of the state’s landmark biometric privacy law.

An exclusion for the recording and distribution of material or information in violation of law barred coverage for claims under the Biometric Information Privacy Act, the US District Court for the Northern District of Illinois said in an order granting summary judgment to Westfield Insurance Co.
