Hertz Spars With Insurers on $168 Million Theft-Prevention Deal

Hertz Global Holdings Inc. pushed Delaware’s top court to reverse a series of lower court decisions letting its insurers off the hook for $168 million paid by the car rental company to settle claims over its theft-prevention practices.

The false arrests at the center of the underlying claims all stemmed from the same acts or general conditions—Hertz’s theft-prevention policy and practices—and therefore should be treated as one “occurrence” triggering the insurers’ duty to pay for the settlement, Allan Moore of Covington & Burling LLP, arguing for Hertz, told the Delaware Supreme Court at a hearing Wednesday.
