Fairfax Insurer Sues Real Estate Brokerage Over Antitrust Cases

A Fairfax Financial Holdings Ltd. insurance unit sued a San Francisco-based real estate brokerage, seeking $2 million in reimbursement for settlement payments and a court declaration that antitrust lawsuits over broker commissions aren’t covered by its policies.

In a complaint filed Monday in the US District Court for the Northern District of California, Allied World Surplus Lines Insurance Co. said it had paid that amount to settle an antitrust class action against Side Inc. under a reservation of rights but believes the payment shouldn’t have been covered under policy exclusions.
