Delaware Top Court Deals Blow to Hertz in Insurance Dispute

Hertz Global Holdings Inc.'s insurers are nearly off the hook for $168 million paid by the car rental company to settle claims over its theft-prevention practices after Delaware’s top court upheld lower court wins for the carriers.

The Delaware Supreme Court in a Wednesday order affirmed a lower court ruling holding that claims over arrests stemming from the company’s practices can’t be aggregated into one “occurrence” for insurance coverage purposes. That means there is likely no coverage because, individually, none of the 364 claims settled by Hertz in 2022 satisfied the $10 million retention after which coverage would kick in. ...
