Delaware Court Clears Up Mattel Product Liability Insurance Issues

A Delaware state judge resolved several issues in an insurance coverage dispute between Mattel Inc. and its insurers over product liability litigation alleging the Rock-N-Play Sleeper sold by the toy company’s subsidiary Fisher-Price Inc. was defectively designed and had hurt or killed infants.

In a Friday order, Delaware Superior Court Judge Meghan A. Adams held that the baby sleeper claims are one “occurrence” under Mattel’s policies and clarified how the claims should be allocated across various umbrella and excess liability policies.
