Contractor Sued by Insurer Over Defective Hospital Window Costs

Starr Indemnity & Liability Co. is seeking a ruling that it has no obligation to indemnify a Missouri contractor for a $49.5 million arbitration award related to defective windows installed at the University of Iowa Stead Family Children’s Hospital.

The award doesn’t constitute covered “property damage” caused by an “occurrence” under commercial general liability policies issued to Cupples International Inc., Starr said in a complaint filed Wednesday in the US District Court for the Southern District of Iowa.
