Chubb Wins New Trial in Long-Running Brooklyn Contamination Case

In a win for a Chubb Ltd. insurance unit, a New York appellate court ordered a new trial on two key issues in a long-running pollution coverage dispute with Brooklyn Union Gas Co.

A trial court gave faulty instructions that may have led a jury to wrongly conclude Brooklyn Union provided timely notice to the insurer about costs incurred to comply with federal and state orders to clean up the contaminated site, the New York Supreme Court, Appellate Division, First Department said in a Thursday order.
