Chubb Ltd. can’t protect CEO Evan Greenberg from being deposed by the Archdiocese of New York over his role in the insurer’s denial of child sex abuse claim coverage, a court referee ruled.
Chubb’s motion for a protective order to block Greenberg’s deposition was denied because New York law doesn’t recognize a special “apex doctrine” that shields high-ranking executives from testifying, referee and former justice Rosalyn Richter said in a May 1 ruling in the New York Supreme Court, New York County.
