Berkshire Unit Sues Chicago Fertility Clinic Over Privacy Case

A Berkshire Hathaway Inc. insurance unit is suing a fertility clinic based in the Chicago area seeking to avoid covering a proposed class action over the alleged use of tracking technologies on its website.

Advanced Reproductive Health Center Ltd., which does business as Chicago IVF, failed to withdraw its request for defense costs even after the carrier disclaimed coverage and the clinic said another insurer was covering its defense, Landmark American Insurance Co. said in a complaint filed Monday in the US District Court for the Northern District of Illinois.
