A Berkshire Hathaway insurance unit is off the hook for defense costs in a dispute between the board and former executives of a diversity, equity, and inclusion nonprofit, a federal court ruled.
The former National Diversity Council executives failed to prove that a policy exclusion for disputes between insured parties shouldn’t apply, Judge Kenneth M. Hoyt of the US District Court for the Southern District of Texas said in a Nov. 27 order.
