A W. R. Berkley Corp. insurance unit sued BH Energy Services, seeking a court declaration that it has no duty to defend the Texas energy company in trade secrets litigation because the claims fall outside its insurance policies’ coverage.
BH Energy’s alleged conduct involves intentional misappropriation of confidential information, which is excluded under cyber incident and intellectual property provisions in commercial general liability and umbrella policies, Berkley National Insurance Co. said in a complaint Tuesday in the US District Court for the Eastern District of Texas.
