Berkley Insurer Sued by Advertising Company Over Trademark Case

An advertising company sued its insurer, a W. R. Berkley Corp. unit, for refusing to defend it in trademark litigation, claiming the carrier breached its contract and duty of good faith.

Ad.com Interactive Media Inc. is seeking coverage for a trademark infringement case brought by Shopnomix LLC and Pronomix.ai LLC, according to its complaint against Gemini Insurance Co. filed Wednesday in the US District Court for the Central District of California.

The underlying plaintiffs said Ad.com used identical trademarks for similar advertising services, causing customer confusion.
