The liquidating trustee of the US Twirling Association is suing the group’s insurers, alleging they wrongfully denied coverage in litigation over the assault of a minor that occurred on a USTA-supervised trip to Peru.
The insurer defendants, including Nationwide Mutual Insurance Co. units, breached their policy by refusing to defend and indemnify the USTA, its president, and a volunteer chaperone in the underlying suit, trustee Mark Dottore said in a Nov. 14 complaint filed in the US District Court for the Eastern District of New York.
