BASF Loses Forum Appeal in Firefighting Foam Insurance Dispute

A BASF SE unit lost an appeal seeking to knock out an insurance coverage dispute filed in New York state court based on a parallel case pending in New Jersey over litigation alleging the chemicals company sold firefighting foam containing “forever chemicals.”

There was no reason to believe the insurers had filed in New York court to gain an unfair advantage, while “there is a significant nexus between New York, the parties, and the matters at issue in the action,” the New York Supreme Court, Appellate Division, First Department, said in a Tuesday order.
