Kinsale Insurance Co. sued contractors that worked on an AT&T fiber optic expansion project in Palm Beach County, Fla., seeking a court declaration that it has no duty to cover claims from a sewage spill caused by drilling operations that released about 6 million gallons of raw sewage into the environment.
Kinsale’s insurance policies contain exclusions that bar coverage for pollution, underground facility damage, and pathogen-related hazards, according to the carrier’s complaint filed April 24 in the US District Court for the Southern District of Florida.
