The state of Utah is urging a federal judge to force Lexington Insurance Co. to cover more than $1 million in legal costs racked up while defending Utah State University in a trade secrets case.
Lexington, an AIG unit that provided excess liability insurance to Utah’s government, kept the state in limbo for more than two-and-a-half years about whether payouts would be available for the defense tab, according to a lawsuit filed Wednesday by Utah’s Department of Administrative Services. The insurer continues to avoid committing in writing to coverage payouts, it said.
