49ers Stadium Builder Loses Bid for Accessibility Suit Defense

The builder of the San Francisco 49ers’ stadium failed to force its insurers into defending it against the NFL team’s negligence lawsuit, after an appeals panel found the venue’s alleged lack of accessibility features wasn’t covered by its insurance policies.

Hartford Fire Insurance Co. and Alterra America Insurance Co. have no contractual duty to front a defense for Turner/Devcon, a joint venture, in the 49ers’ litigation, the U.S. Court of Appeals for the Ninth Circuit held Monday in an unpublished opinion.
