Affiliates of celebrity billionaire Mark Cuban took a major step forward in their quest for $2.6 million held back by Cohen Exhibition Co. after its $149 million acquisition of Landmark Theatres, when a Delaware judge rejected claims that the Cuban companies won a related arbitration through fraud.
Vice Chancellor Paul A. Fioravanti Jr. granted summary judgment to Roma Landmark Theaters LLC and MCC Entertainment LLC, which sued in Delaware’s Chancery Court to have the money released from escrow after Cohen questioned an accounting arbitration performed by PricewaterhouseCoopers LLP.
