Disney Whittles Away Claims in Avengers Face-Tech Software Suit

Disney again convinced a federal court to dismiss copyright infringement claims in a lawsuit involving facial movement technology used in two of its Avengers movies.

The owner of the MOVA Contour Reality Capture program, Rearden LLC failed to show in its fifth amended complaint that TWDC Enterprises 18 Corp.—formerly known as The Walt Disney Co.—committed direct or contributory infringement, Judge Jon S. Tigar of the US District Court for the Northern District of California said Wednesday. But the judge allowed a vicarious infringement claim against Disney to proceed.
