A Pennsylvania federal district court denied Resources for Human Development, Inc.'s motion to dismiss the claims of a class of providers that they were not paid for all hours worked during their shifts, in violation of the Fair Labor Standards Act and state law, ruling that while the automatic sleep time deduction policy is permissible, the providers still need to be paid for time worked during that period, and need to be able to record their time worked during that period.
