A New Jersey federal district court granted summary judgment to Wayfair, LLC on the claims of a warehouse associate who had Covid-19 that he faced discrimination and was discharged due to a disability, in violation of state law, ruling that Wayfair’s proffered reason for the discharge of violating company policy by reporting to work while experiencing Covid-19 symptoms, was legitimate and nondiscriminatory, without pretext, and that the associate wasn’t a qualified individual under the statute.
