Business Groups Sue Over California Emissions Reporting Law (1)

California’s new first-in-the-nation emissions reporting law was challenged Tuesday in federal court by business groups that say the emissions disclosures required by the law violate the First Amendment’s protections against compelled speech.

The groups argue the law and another measure requiring companies to file reports on climate-related risks would also affect businesses far beyond California’s borders in violation of the Commerce Clause.

The lawsuit comes as the US Securities and Exchange Commission considers similar rules for publicly traded firms and underscores both the potential reach of California’s new requirements, as well as the depth of business opposition to such mandates ...
