Mexican Immigrant Loses Due Process Bid to Avoid Removal

A Mexican citizen’s due process challenge to the denial of his request for cancellation of removal was rejected by the Eleventh Circuit Wednesday.

But Rosendo Ponce Flores wasn’t deprived of anything in which he had a liberty interest, even if his counsel was ineffective, the US Court of Appeals for the Eleventh Circuit said. It also said it lacked jurisdiction to review certain immigration matters, including the factual findings underlying Ponce Flores’ removal.
