MGM Resorts Gets Claims Trimmed in Retirement Fee Class Action

A class action challenging MGM Resorts International’s retirement plan fees is moving toward trial on just a single issue after a federal judge resolved key aspects of the case in favor of the hotel and casino company.

The lawsuit accuses MGM of filling its 401(k) plan with high-fee investment options when identical options are available at lower cost, and of allowing the plan to charge excessive recordkeeping fees. Judge Jennifer A. Dorsey granted the gaming and hospitality company’s motion for partial summary judgment, which left the latter to claim for resolution at trial.
