Zyn Manufacturer Escapes Nicotine Pouch Products Monopoly Suit

Zyn maker Swedish Match North America LLC and its parent company Philip Morris International Inc. convinced a federal judge to throw out a case claiming they monopolized the nicotine-pouch market.

“Because Plaintiffs fail to plausibly allege that Defendants engaged in anticompetitive conduct, both their monopolization and attempted monopolization claims under Section Two of the Sherman Act fail,” Judge David J. Novak of the US District Court for the Eastern District of Virginia said in a Thursday order granting the companies’ motion to dismiss the suit with prejudice.
