Xytex Corp., a leading reproductive services provider, must defend claims it misrepresented a sperm donor’s key traits to customers, leading parents to fear for their offspring’s well-being (Doe v. Xytex Corp., 2017 BL 94735, N.D. Cal., 16-cv-2935, 3/24/17).
The U.S. District Court for the Northern District of California refused to dismiss claims brought by a same-sex couple who conceived a child using sperm supplied by Xytex. A Xytex representative allegedly told them the donor was “ultra intelligent” and looked “like a model.” In reality, the donor was “a mentally schizophrenic felon,” according to the court.
