DOJ OPPOSITION MAY NOT KILL GILEAD WHISTLEBLOWER CASE

Is Justice Department opposition to a whistleblower false claims lawsuit a death knell for the case? Some judges believe so, saying the DOJ has “unfettered” power to end whistleblower suits under the False Claims Act.

But this may not be the outcome for a false claims complaint against Gilead Sciences Inc., which the whistleblowers allege defrauded the government by misrepresenting the contents of its HIV drugs to the FDA. The DOJ seeks to have the case dismissed, but the whistleblowers won’t go down without a fight. Daniel Seiden investigates.
