Wellpath Ordered to Disclose Report About Inmate’s Suicide Death

A medical report that an Oregon county jail’s health-care provider was contractually obligated to make isn’t protected from discovery by a federal shield law.

Wellpath LLC must disclose the report to an inmate’s estate in civil rights litigation stemming from her death because it’s not covered by the Patient Safety and Quality Improvement Act’s privilege for “patient safety work product,” the US District Court for the District of Oregon said.

PSWP doesn’t include reports prepared for reasons other than submission to a patient safety organization to be studied for purposes of improving care, the court said.
