Virginia Realtor Health Plan Law Draws HHS Caution, GOP Response

The Biden administration is facing blowback for attempting to enforce federal health insurance market reforms that run up against Virginia state law.

Under Virginia’s HB 768/SB 335 law, state realtors can pool together and insure employees under a single health plan. Signed by Gov. Glenn Youngkin in 2022, the law was billed by its backers as a vehicle for helping realtors negotiate better plans with insurance providers.

But on May 31, the Biden administration sent a letter to Youngkin saying the law ran afoul of the federal Employee Retirement Income Security Act, or ERISA.
