Idaho and six other states urged the Ninth Circuit to allow them to join a case testing federal regulations of mifepristone despite the US Supreme Court’s rejection of a similar Texas-based challenge.
But the court should affirm the denial of the Idaho-led group’s motion to intervene in Washington’s lawsuit to do away with a risk evaluation and mitigation system that governs the drug, Attorney General Robert W. Ferguson said in a brief filed in the US Court of Appeals for the Ninth Circuit Thursday.
