A lawsuit challenging the Inflation Reduction Act’s Medicare drug price negotiation program doesn’t belong in Texas, the US said in a motion to dismiss the suit.
Only one of the three plaintiffs, the National Infusion Center Association, has any ties to the state, and it failed to allege that the federal program will cause any of its members an injury, US Health and Human Services Secretary Xavier Becerra said Monday.
Becerra asked the US District Court for the Western District of Texas to dismiss NICA for lack of standing and, subsequently, to dismiss the lawsuit for improper venue.
