US Seeks Quick Redo in Idaho Emergency Abortion Care Lawsuit

Allowing Idaho to enforce its near-total abortion ban against Medicare-participating hospitals will threaten medical professionals with criminal prosecution if they provide patients with federally required emergency care, the US told a federal appeals court.

The federal government asked the US Court of Appeals for the Ninth Circuit on Sept. 30 for full-court reconsideration of an order that allowed Idaho to enforce state law in circumstances that allegedly conflict with hospitals’ duties under the federal Emergency Medical Treatment and Labor Act.
