US Gets States’ Support in Idaho Emergency Abortion Care Case

Idaho’s near-total abortion ban must give way to a federal emergency care law when the procedure is necessary to treat a pregnancy-related medical emergency, several states have said.

Twenty-three states and Washington, D.C., filed a brief with the US Court of Appeals for the Ninth Circuit on Monday supporting the US’s efforts to hold on to a preliminary injunction issued by Judge B. Lynn Winmill. The judge’s order blocked the state from enforcing its anti-abortion law against doctors in a way that would conflict with the the Emergency Medical Treatment and Labor Act.
