US Defeats Claim That Ob-Gyn’s Malpractice Led to Baby’s Death

The US wasn’t liable for a baby’s death that occurred shortly after his birth because a federally employed doctor wasn’t shown to have violated care standards while treating the mother before and during his delivery, a federal appeals court said.

The evidence heard by a federal judge during a four-day bench trial supported a finding that the obstetrician-gynecologist justifiably relied on nurse’s reports when she discharged the mother after an emergency medical condition she experienced shortly before the birth, the US Court of Appeals for the Sixth Circuit said in an unpublished decision Thursday.
